Terms of Service

Welcome to Tokkin. By creating an account or using our service you accept these terms. Please read them carefully.

1. What Tokkin is

Tokkin is a software (SaaS) tool for private lenders to manage their own loans, borrowers and collections, and to send contractual reminders via WhatsApp from their verified number.

Tokkin is not a financial institution. We do not grant loans, we do not intermediate between lenders and borrowers, and we are not a party to the loan contracts our users enter into with third parties.

2. Your account

• You must be at least 18 years old and have legal capacity to contract.
• Information you provide must be true and up to date.
• You are responsible for keeping your password secret and for all activity from your account.

3. Acceptable use

By using Tokkin you agree to:

• Comply with applicable laws, including financial consumer protection and debt collection rules.
• Not use Tokkin for usury, harassment, abusive collection or fraud.
• Not send WhatsApp messages with threatening, offensive or false content.
• Respect Meta/WhatsApp policies. Non-compliance may result in suspension of your number.
• Obtain the consent or legal basis required to process your borrowers' data.

4. Responsibility for borrower data

When you upload borrower data into Tokkin, you are the data controller and Tokkin acts as a processor. You must have a legal basis to process that data and to send messages, and you are responsible to your borrowers for the use you make of the service.

5. Plans and payments

• We offer a free plan with limits and paid plans (Pro and Business).
• Subscriptions renew automatically until cancelled.
• Mobile payments are handled via Apple App Store or Google Play.
• We do not refund billed periods unless legally required.

6. Intellectual property

Tokkin and its software are owned by the Tokkin team. No license is granted to the trademark or source code. You retain ownership of the data you upload.

7. Service availability

We make reasonable efforts to keep the service available, but we do not guarantee a specific level of availability. We may suspend the service for maintenance with reasonable notice.

8. Limitation of liability

To the maximum extent permitted by law, Tokkin will not be liable for indirect damages, loss of profit, loss of data, or damages arising from the inability to use the service. Our total liability is limited to the amount you have paid Tokkin in the last 12 months.

9. Suspension and termination

We may suspend or terminate your account if you breach these terms, if we detect fraud, or if required by a competent authority. You may cancel your account at any time from the app or by writing to hello@tokkin.app.

10. Changes to these terms

We may update these terms. We will notify you inside the app or by email. Continued use after the notice implies acceptance.

11. Governing law

These terms are governed by the laws applicable to the domicile of the Tokkin operating team. Any dispute will be resolved by the competent courts of that jurisdiction.
